These Terms of Service (“Terms”) govern your access to and use of Send in Public (“Send in Public,” “we,” “our,” or “us”), including our website, applications, and services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms.
1. Description of the Service
Send in Public is a founder-led outbound and content enablement platform that assists users in managing and sending email sequences and related outreach activities on their behalf.
The Service may connect to third-party email providers, including Google Workspace and Gmail, via OAuth authorization. Send in Public operates primarily using user-provided subdomain email accounts for outbound sequencing and communication.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. You represent that you have authority to connect any email account you authorize through the Service.
3. Google OAuth and Limited Use Disclosure
Send in Public’s use of information received from Google APIs adheres strictly to the Google API Services User Data Policy, including the Limited Use requirements.
Specifically:
We access Gmail data only to perform user-initiated email sending, reply detection, and sequencing functions
We do not use Google user data for advertising
We do not sell, rent, or share Google user data with third parties
We do not use Google user data to train machine learning or AI models
Access is limited to the minimum scope necessary to provide the Service
Google user data is accessed solely to enable outbound email delivery, inbox monitoring for replies, and sequencing logic explicitly configured by the user.
4. Data Access and Use
Depending on the permissions you grant, Send in Public may access:
Email metadata (sender, recipient, timestamps)
Email content necessary to send messages or detect replies
Account-level configuration required for sequencing logic
We do not access personal inboxes for unrelated reading, analysis, or storage beyond what is required to operate the Service.
5. User Responsibilities
You agree to:
Use the Service in compliance with all applicable laws and regulations
Ensure that recipients of outbound messages are contacted in a lawful manner
Comply with email regulations including CAN-SPAM, GDPR, and other applicable anti-spam laws
Maintain accurate account information
Refrain from using the Service for abusive, deceptive, or unlawful outreach
You are solely responsible for the content of emails sent through your connected accounts.
6. Prohibited Uses
You may not use the Service to:
Send illegal, misleading, or fraudulent communications
Harvest or scrape personal data without lawful basis
Impersonate individuals or organizations
Circumvent email provider safeguards
Violate Google Workspace, Gmail, or other third-party service terms
Violation of these restrictions may result in immediate suspension or termination.
7. Data Retention and Security
We retain user data only for as long as necessary to provide the Service or comply with legal obligations.
Send in Public implements reasonable administrative, technical, and organizational safeguards designed to protect data against unauthorized access, disclosure, or misuse.
Users may revoke Google OAuth access at any time through their Google Account settings.
8. Third-Party Services
The Service integrates with third-party platforms such as Google Workspace, Gmail, and other email or automation providers. Send in Public is not responsible for the availability, functionality, or policies of third-party services.
Your use of those services remains subject to their respective terms and policies.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding deliverability, performance, or outcomes from outbound communication.
11. Limitation of Liability
To the maximum extent permitted by law, Send in Public shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Service.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
